Struck-off nurse has ban overturned after appeal

A psychiatric nurse who was accused of putting his hand down a patient's pyjama bottoms and touching her inappropriately has had his ban from the profession overturned.
In November, the Nursing & Midwifery Council (NMC) said Emakpor Marvin Ogo had engaged in sexually motivated activity while working at the East London Foundation Trust’s Crystal Ward, in Luton.
Mr Ogo had strongly denied the allegations but, following a misconduct hearing, a panel ruled his fitness to practise was impaired and he was struck off the nursing register.
The nurse appealed the decision and this month a panel ruled in his favour, concluding his fitness to practise was not impaired.
The NMC said: "We can confirm [Mr Ogo] did successfully appeal and following a new hearing, a fitness to practise panel found that their fitness to practise is not impaired."
The health watchdog said it could not disclose whether any of the previously proven allegations against Mr Ogo were upheld.
Mr Ogo had been charged by prosecutors with penetration and sexual assault of a patient but was found not guilty by a jury at Luton Crown Court.
