  • Lawyers for the two teenagers had opposed the media application to lift the restrictions, citing the possible ramifications on their welfare

  1. Judge considers motivations of murderpublished at 15:12 Greenwich Mean Time 2 February 2024

Mrs Justice Yip reads out the considerations of the sentencing, noting that the question surrounding the case is whether the murder was "motivated by hostility to Brianna because she was transgender".

She adds that her conclusions on the case are "important but not decisive" as she is required to determine how serious the crime is.

  2. Judge explains scope for sentencingpublished at 15:10 Greenwich Mean Time 2 February 2024

Now Justice Yip is talking about the scope for sentencing.

Because a knife was taken to the scene, the starting point is 17 years, she says.

"This is the starting point, not the end point," she adds, explaining that she also has to consider the aggravating and mitigating factors.

  3. Ratcliffe's autism diagnosis does not explain his description of Brianna, judge sayspublished at 15:10 Greenwich Mean Time 2 February 2024

The judge acknowledges that Eddie Ratcliffe has been diagnosed on the autistic spectrum.

But she tells Ratcliffe that he went to an ordinary school and liked to be thought of as an intelligent person, even if he was socially awkward.

Mrs Justice Yip says Ratcliffe's diagnosis does not explain the way he referred to Brianna, but it does have some bearing on the sentence.

  5. Ratcliffe agreed Brianna would be easiest victim, says judgepublished at 15:08 Greenwich Mean Time 2 February 2024

Justice Yip tells Ratcliffe that there is insufficient evidence to say you were motivated by sadistic desires, but you knew Jenkinson did enjoy the idea of killing and encouraged that.

She says Ratcliffe referred to Brianna in transphobic language and in a way that was dehumanising, "calling her, 'It'".

Ratcliffe agreed that Brianna would be the easiest victim, Justice Yip says.

  6. I'm satisfied you're capable of holding your own views, judge tells Ratcliffepublished at 15:07 Greenwich Mean Time 2 February 2024

Mrs Justice Yip says Ratcliffe's explanation for his transphobic attitudes was that he was "just copying language to fit in", including language used by Jenkinson.

But, she adds, "you were not following Scarlett's lead", saying she used the correct pronouns for Brianna.

"I am satisfied that you are quite capable of holding your own views," the judge says.

  7. Judge says it would be 'wholly wrong' to suggest Ratcliffe was under Jenkinson's controlpublished at 15:04 Greenwich Mean Time 2 February 2024

Mrs Justice Yip continues addressing Eddie Ratcliffe.

She says he was not involved in Scarlett Jenkinson's first attempt to kill Brianna with tablets.

When that attempt failed, however, the judge says, Ratcliffe suggested other ways to kill her.

It would be "wholly wrong" to say you were under Scarlett's control, Mrs Justice Yip tells Ratcliffe.

But on the other hand, she says, Ratcliffe was not the "driving force" behind Brianna's murder - Jenkinson was.

  8. Ratcliffe supported Jenkinson's fantasies, judge sayspublished at 15:03 Greenwich Mean Time 2 February 2024

Addressing Eddie Ratcliffe directly, Mrs Justice Yip says he "did not show the same interest in killing as Scarlett did."

However, she also acknowledges that he "supported" Jenkinson's fantasies.

Discussing their relationship, she says that Jenkinson looked up to Ratcliffe but that Ratcliffe saw her as someone who "could help him socially".

  9. You wanted to make a victim feel pain and fear, judge tells Jenkinsonpublished at 15:02 Greenwich Mean Time 2 February 2024

"Your motivation, Scarlett, was to act out your fantasy," Mrs Justice Yip says to the 16-year-old offender.

"You wanted to make a real victim feel pain and fear," she adds.

She says Jenkinson told Ratcliffe that she wanted to see "horror" on Brianna's face and hear her scream.

Jenkinson also said she wanted to keep some of the victim's body parts.

"Two days before the murder you said you were excited," the judge adds.

  10. Fantasy of killing turned into something real, judge sayspublished at 15:02 Greenwich Mean Time 2 February 2024

Mrs Justice Yip next addresses Jenkinson, saying that she introduced the idea of killing people.

Justice Yip says at first it was a fantasy, but it developed into something real and Jenkinson had a list of people she wanted to kill.

She continues by stating that Jenkinson did however like Brianna, unlike other people on her list, and introduced Ratcliffe to her.

The judge says Jenkinson gave Brianna ibuprofen tablets which made her ill.

Jenkinson made a plan to kill someone in the park and used that plan on Brianna, who was vulnerable and abused her friendship, Mrs Justice Yip adds.

  11. Case has shocked public, judge sayspublished at 14:59 Greenwich Mean Time 2 February 2024

Mrs Justice Yip calls the case unusual, saying it has "shocked the public".

She says she has thought about the features of the case very carefully, especially because Scarlett Jenkinson and Eddie Ratcliffe are themselves children and are granted certain protections under the law.

The minimum sentence will therefore be shorter than what she may have given adults, the judge says.

  12. Judge says she is satisfied both teens played part in killingpublished at 14:58 Greenwich Mean Time 2 February 2024

Mrs Justice Yip next addresses Ratcliffe, saying she is satisfied that "at least some of the wounds were inflicted by you".

She adds that Scarlett's jacket did not appear to have Brianna's blood on it.

"I cannot be sure precisely who did what, but that does not matter for today's purposes," Yip says.

"But I am satisfied that both of you played a part in killing Brianna", she says, adding that she has treated both offenders as individuals.

  13. Jenkinson blurs lines between fantasy and real life - judgepublished at 14:57 Greenwich Mean Time 2 February 2024

Mrs Justice Yip is now addressing the defendants, saying both told lies to the jury.

Turning to Scarlett Jenkinson, Mrs Justice Yip tells her that she's changed her story but admitted that she enjoyed her part in the murder of Brianna and that she "blurs the lines between fantasy and real life".

Mrs Justice Yip says Brianna was only 16 and had her whole life ahead of her.

"She had some struggles but was supported by her loving family," the judge says, adding "even though her life was short she made an impact".

Brianna's family's loss is "unimaginable", the judge says, "but they have bravely painted a picture of her in their statements - they have my deepest sympathy".

Speaking to the killers, she says: "You, Scarlett and Eddie were friends since the age of 11… Scarlett you knew Brianna from school, you got her to meet you in Linear Park - she could not possibly have known you were a danger to her.

"I don’t want to dwell on the murder itself but it was brutal," she adds, saying Brianna suffered 28 stab wounds and "wounds to the arms show she tried to defend herself".

"Taken together the injuries point to a sustained and very violent assualt," Yip says.

  15. Judge says killers will only be released if they are no longer seen as a dangerpublished at 14:51 Greenwich Mean Time 2 February 2024

Mrs Justice Yip opens her sentencing remarks.

She says she must set the minimum term before Scarlett Jenkinson and Eddie Ratcliffe can be released

"You will only be released if you can no longer be seen as a danger," she explains.

She adds that if "you remain a danger, you may never be released".

She adds that since the killers are "very young", she hopes they can get over and work through what motivated them to kill.

Scarlett Jenkinson is fidgeting. She is repeatedly folding a piece of paper, and reopening it again.

Scarlett is chatting to her intermediary worker, whilst waiting for the hearing to begin. Eddie Ratcliffe is sitting silently, looking straight ahead.

The two teenagers are at opposite ends of the row of seats in the dock. There are five adults sitting in between them.

The atmosphere in court is expectant. The judge, Mrs Justice Yip said that she hoped to start her sentencing remarks at 2:15, but isn’t yet in the room.

The court is sitting in silence, waiting for Mrs Justice Yip to enter. Every seat is full.

Members of Brianna’s family are sitting across several benches. Relatives of the two teenage murderers Scarlett Jenkinson and Eddie Ratcliffe are also here.

The glass-fronted dock of courtroom number two is full. That’s because the two teenagers are sitting alongside support workers and prison officers.
