    BBC Radio Stoke

The family of a five-year-old boy born with breath problems are waiting this week for a judge to rule on a judicial review over the management of gas emissions from a landfill.

Lawyers representing Mathew Richards and his family, who live near Walleys Quarry in Silverdale, Staffordshire presented a case over three days in the High Court last week.

Doctors have said the five-year-old's breathing problems have been made worse by hydrogen sulphide (H2S) from the site.

The case was brought against the The Environment Agency, which told the High Court it has plans in place to reduce noxious gas emissions at an under-fire landfill.

It is still a huge amount of money...we wouldn't just need the asking price, we'd need to make various improvements to the property. Our fear is that a private purchaser will come along, pay the asking price, put up a 6ft high fence and the public will no longer be allowed in and if that happens then we no longer have a centre for refreshment."
