    The court heard Smalley, a company director for a scrap metal company for 20 years, was dealing with personal issues when he made the false statement in January.

    In mitigation, his lawyer told the court: "Politics was a useful diversion from the stresses and strains. It was that stress which explains why a man of 49-years-old and previous good character finds himself in the situation he is in."

    District judge Jonathan Taaffe said: "This is an extremely serious case. All options including custody will have to be considered in relation to this matter."

    A little more now on ex-Tory city councillor Richard Smalley, who's been warned he could face jail after admitting giving a false address in this year's local elections.

    The prosecution told magistrates in Derby Mr Smalley knew Allestree was a safe Conservative seat and he claimed to live at the address of someone he knew so that he could stand at the election.

    However, he actually lived in Borrowash - outside the Derby city boundary.

    A former Conservative councillor from Derby has pleaded guilty to providing false information at this year's local election.

    Richard Smalley, from Borrowash, was elected as an Allestree Ward councillor in May but later decided to stand down.

    He appeared before magistrates this morning and admitted falsely claiming to live at an address in Allestree that belonged to a friend.

    Isobelle Shorrock is from the campaign group Kedleston Voice, which has fought to stop homes being built on the edge of the Kedleston estate and raised £40,000 to present its case.

    She's hoping it isn't the end of the line and that the application isn't decided by the decision of one man.

    The Planning Inspectorate has dismissed the harm to Kedleston Hall's setting as "negligible" and set out conditions for the 400-home development to go ahead.

    Amber Valley Borough Council originally turned down the plans following opposition from the National Trust and residents.

    The developer, Catesby Estates, has been unavailable for comment.
