    Amy Woodfield
    BBC News

An investigation into the death of a Leicester schoolgirl at Drayton Manor theme park has found the circumstances did not meet the threshold for gross negligence or corporate manslaughter.

Evha Jannath fell from the Splash Canyon ride on a school trip in May 2017.

The 11-year-old was airlifted to hospital but was confirmed dead shortly after arrival. A forensic pathologist concluded Evha died as a result of drowning.

Last year the Crown Prosecution Service (CPS) received a file from Staffordshire Police to decide if any charges should be brought.

After making a decision not to prosecute Drayton Manor the case has been formally handed over to the Health and Safety Executive (HSE).

The HSE said: “This remains a criminal investigation and we will be considering whether there were any breaches of health and safety law relevant to the circumstances of this tragic event."

Keith Vaz, the MP for Leicester East, represented the family throughout this case.

He said: "The family are grateful to the police for their thorough investigation of this matter. They welcome the decision of the Health & Safety Executive to take over the case. They hope it can be done speedily.

"The delay in this matter has been intolerable. It is now almost one year and 10 months since this tragedy occurred."

A file has been prepared for the coroner and an inquest into Evha's death will take place later this year.
