Five people were injured in a crash involving a National Express coach, a car and a lorry on the M1 in Leicestershire on Thursday evening.
Police said the driver of the Ford car was taken to hospital with non-life-threatening injuries following the crash between junctions 22 and 23 of the northbound carriageway at about 20:10.
Four passengers on the London to Bradford service suffered minor injuries, with one being taken to hospital.
Both carriageways were closed for several hours.
The force said a 33-year-old man was reported for the offence of failing to provide a specimen for analysis and will appear at court at a later date. Police did not say which vehicle he was driving.
National Express said: "Emergency services attended the scene and one passenger was taken to hospital.
"We have made follow-up contact and they are now home following medical checks.
"All other passengers were transferred to an alternative vehicle to continue their journey."
A trial for the defendants is set to begin in November and could run for six weeks.

A 14-year-old girl was sexually assaulted by two teenagers in Wigston, police said.
Officers said the girl was approached by two teenage boys who "touched her inappropriately" on Croft Drive, near to the junction with Bradgate Drive, on Monday evening.
They then ran off in the direction of Shackerdale Road.
PC Kate Butler said: “This incident took place in late afternoon when many people are likely to have been out and about.
“We would like to hear from anyone who may have seen these boys or may have captured them on CCTV or dashcam.”

British Transport Police (BTP) has issued a warning over the dangers of trespassing on railway lines after two 12-year-olds were almost hit by a train when they ran in front of it.
The pair caused the driver to do an emergency stop on Wednesday in Wollaton, Nottinghamshire.
BTP said it has been officially recorded as a "near miss", meaning death or injury would have likely otherwise have occurred.
The force said there have been other trespassing issues nearby including a pile of debris found on the line near Trowell three days earlier.
On a separate occasion, youths were seen placing items on the track near Courtney Close, Wollaton.
Insp Ellis Turner, from BTP Nottingham, said: “Too many times we have seen the tragic consequences of young people ignoring the warnings about trespassing on the railway and taking risks, resulting in terrible injuries or death.
“It’s vital parents and guardians play their part and ensure they know where their children are and what they are up to."
