    Reporting from court

The exchanges between Susan Necheles and Stormy Daniels are occurring at a rapid-fire pace.

Justice Merchan interjects to remind Necheles that only one person can speak at a time so the testimony can be accurately recorded by the stenographers.

  2. Daniels gestures to Trump in rare acknowledgementpublished at 16:12 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Susan Necheles asks how an adult-film star could be jarred by the sight of finding Donald Trump in his boxers and t-shirt.

Daniels testified on Tuesday that she had a visceral reaction when she allegedly walked out of the bathroom and first saw Trump on the bed.

As she replies to the question, Daniels gestures over to Trump briefly with a sweep of her hand - one of the few times she's directly acknowledged that he is sitting right there in the same room.

Trump has always denied any sexual liaison with Stormy Daniels, although he has admitted that she was paid to keep her allegations quiet.

  3. Raised voices again, as Daniels quizzed over dinnerpublished at 16:10 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

Trump's lawyer Susan Necheles is grilling Daniels about whether she actually ate dinner on the night of the alleged sexual encounter.

Daniels tells the court she never got food that night, and she would remember that, because she is “very food motivated”.

Necheles then references Daniels’ interview with Anderson Cooper in which she says the two had dinner in the room.

Daniels says she meant they just had “dinner time” and maintains that she never got food.

“Your words don’t mean what you say,” Necheles says, raising her voice.

A prosecutor then raises an objection that is sustained.

Battle of wits: Stormy Daniels clashes with Trump's lawyerpublished at 16:04 British Summer Time 9 May

    Nada Tawfik
    Reporting from court

This cross-examination has become a real battle of wits.

Stormy Daniels is using a mix of humour and indignation to try to undercut every one of Necheles' attempts at discrediting her.

At one point, she tells Trump's lawyer: “You're trying to trick me into saying something that isn't entirely true."

Other times, she tries to get the upper hand herself.

When asked about her adult films, she slips in a reference to the alleged sexual encounter with Trump.

“The sex in those films was very much real just like what happened to me in that room,” she says.

Daniels is certainly keeping Trump’s lawyer on her toes and interrupting her flow. It’s made for a riveting set of exchanges.

  5. Trump and bodyguard 'always together', Daniels sayspublished at 16:00 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

Several times today, Trump’s bodyguard Keith Schiller has come up during Stormy Daniels’ testimony.

Daniels told the court on Tuesday that Schiller was the person who approached her at the golf tournament in 2006 to ask - on Trump’s behalf - if she wanted to have dinner with him.

Necheles is asking Daniels about this encounter again now.

Trump and Schiller were “always together”, Daniels says, holding two fingers together and saying "they were like this".

A long-time bodyguard of Trump, and later, his director of Oval Office operations in the White House, Schiller could serve as a crucial witness for prosecutors.

He’s on their list of potential witnesses. Because Daniels says Schiller was at Trump’s hotel on the night of the alleged sexual encounter, he could play a pivotal role in how the jury interprets Daniels' own testimony.

  6. Stormy Daniels quizzed about details of alleged sexual encounterpublished at 15:53 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Susan Necheles is now trying to discredit aspects of Stormy Daniels' allegations of a sexual encounter with Trump. She begins to ask Daniels about the details that she provided in court on Tuesday.

Necheles asks if she met with the prosecutors before testifying, and if they asked her to include lots of details about the events where she first met Trump, to bolster her credibility.

Daniels responds that yes, she was supposed to include "true facts". (It's important to remember that witness preparation is a standard part of all trials, and each opposing party can do this.)

Necheles begins to ask Daniels a series of questions about the specific details - the floor, the suite she allegedly met Trump in, who was at the 2006 golf tournament - trying to undercut Daniels' recollections.

For the most part, however, Daniels appears to keeps to the details she has already shared publicly.

Trump's lawyer is looking for inconsistencies in Stormy Daniels' story, between her book and the testimony she gave on Tuesday, to try and undercut her credibility.

  7. Trump's reaction to Daniels' testimonypublished at 15:48 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

Donald Trump seems to be glowering during this latest line of testimony - including Daniels saying she "didn't have to write" the story about her alleged sexual encounter.

He goes from hunching forward with a stern expression to leaning back and closing his eyes.

Trump has always denied the allegations of any sexual encounter with Daniels.

  8. Daniels grilled about adult-film careerpublished at 15:45 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Susan Necheles moves in for yet another line of attack: Stormy Daniels' long history of acting in and directing adult films.

"You have a long history of making up stories about sex?" Necheles asks.

“The sex in the films is very much real," Daniels replies. "Just like what happened to me in that room.”

She appears to be referring to her alleged sexual encounter with Trump - which he denies ever happened.

"If that story wasn't true, I would have written it to be a lot better," Daniels says.

  9. An unusual pivot to talk about the paranormal and a giant possumpublished at 15:40 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Susan Necheles has pivoted to another way to undercut Stormy Daniels' credibility: bringing up her interests in the paranormal. Daniels has spoken about such subjects on podcasts and shows in the past.

She is interested in doing a TV show about the paranormal, UFOs, and other unexplained phenomenon.

Daniels said that she lived in a house in New Orleans that had "unexplained activity".

“A lot of the activity was debunked," she later clarifies - it was a giant possum under the house.

  10. Defence shows Daniels' tweets after Trump indictmentpublished at 15:36 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Susan Necheles is showing the court tweets that she argues prove Stormy Daniels was trying to profit from Trump’s indictment.

“Thank you to everyone for your support and love!” one of Daniels’ posts reads. “I have so many messages coming in that I can respond, also don’t want to spill my champagne.”

"The champagne refers to a celebration that Trump was indicted?" Necheles asks.

    Daniels does not disagree.

  11. Court sees Stormy Daniels merchandisepublished at 15:33 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

We’re looking at merchandise from Stormy Daniels’ store now.

Susan Necheles is once again trying to make the argument that Daniels is motivated by money, because she tweeted a link to her store after Donald Trump was indicted.

Some of the merchandise says #TeamStormy.

We're also seeing a picture of Daniels on a candle dressed as a saint.

Necheles accuses Daniels of celebrating and making money off Trump’s criminal charges.

“Not unlike Mr Trump,” Daniels replies to Trump's lawyer.

Trump has sent dozens of fundraising emails asking for money to help him fight his criminal indictments.

  12. 'I am not a toilet' - Stormy Danielspublished at 15:30 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

We're only an hour in, and it’s already been another colourful day in court.

Trump’s attorney Susan Necheles has just said the word “turd” three times, quoting a tweet from Stormy Daniels in which she says she is the “best person to flush the orange turd down”.

Daniels was responding to a tweet in which someone calls her a “human toilet”.

Necheles is trying to get Daniels to say that her tweet meant she wanted Trump to go to jail.

Daniels denies this, saying nothing can be taken away from the tweet, because she is “not a toilet”.

  13. Daniels says she got 'bad' publicity after 60 Minutes interviewpublished at 15:29 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Eventually, despite the NDA, we all know Stormy Daniels’ allegations came out in 2018. Susan Necheles argues that Daniels sought to benefit from all the publicity.

Daniels' then-lawyer Michael Avenatti arranged an interview with journalist Anderson Cooper on the show 60 Minutes.

Daniels tells the court she was not paid for that interview.

Susan Necheles asks if the interview got her lots of publicity. Daniels says yes, but it was “bad” publicity.

"You knew getting a lot of free publicity for your story would allow you to make more money?" Necheles asks.

Daniels responds that she was unprepared for just now much attention it would generate.

Necheles also brings up her lucrative book deal, for which Daniels was paid an advance worth hundreds of thousands of dollars.

But as we've already reported, Daniels did not see much of that money because Avenatti stole it.

  14. Trump sits back with eyes closedpublished at 15:23 British Summer Time 9 May

    Madeline Halpert
    Reporting from New York

Donald Trump appears to have had his eyes closed for the past five or so minutes of testimony.

He is sitting back in his chair in his blue suit and blue tie.

The former president has been mocked online after some media outlets reported he may have fallen asleep during proceedings, with #SleepyDon going viral online.

But Trump hit back, writing on Truth Social last week that he doesn't fall asleep, he just listens intently and sometimes rests his "beautiful blue eyes".

  15. Stormy Daniels smirks as she is questioned about lawyer who stole from herpublished at 15:20 British Summer Time 9 May

    Madeline Halpert
    Reporting from New York

Daniels’ testimony today has offered a glimpse into one of the scandals surrounding her coming forward about her alleged sexual encounter with Donald Trump.

“You hired Michael Avenatti to be your lawyer, right?” Trump's lawyer asks Daniels.

“Yes,” Daniels says, smirking as she does so. Her visible reaction to his name elicits laughter in the overflow room.

Daniels told the court on Tuesday that she hired Avenatti to help get out of the non-disclosure agreement.

It was a decision she would later regret.

Avenatti was eventually sentenced to 14 years in prison for defrauding Daniels and other clients.

He was convicted of stealing $300,000 from her - money she was supposed to receive for a book contract.

  16. NDA agreement brought up in court, againpublished at 15:14 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

We're now seeing some familiar documents.

They came up during testimony from Stormy Daniels’ ex-lawyer, Keith Davidson, who negotiated the payout to Stormy Daniels and managed her response to later reports about the hush money.

Susan Necheles displays the settlement agreement Daniels signed in 2016, conveying her $130,000 in exchange of her silence about allegations of a sexual liaison with Trump.

We go over various aspects of the contract, and Daniels agrees to a certain set of facts.

“I signed this based upon what my attorney suggested I do,” Daniels says, noting she is not a lawyer.

Trump’s attorney again pulls up an old piece of evidence: the 2018 statement that her lawyer Keith Davidson wrote for her, denying reports in the Wall Street Journal that she had been paid for her silence and that she allegedly had an affair with Donald Trump.

“Let me be clear I did not write this,” Daniels says. “It was given to me and was I told I had to sign it.”

Davidson testified earlier in the trial that he had meticulously crafted the statement so that Daniels would not technically be lying (she does not allege an “affair” with Trump, for example, but rather a single encounter) and that he had her sign the document.

  17. Trump remains stone-faced as Stormy Daniels testifiespublished at 15:07 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

Donald Trump is keeping a straight face as he listens to Stormy Daniels' testimony today, occasionally whispering to his lawyer Todd Blanche.

On Tuesday, he got in trouble with Justice Merchan. Justice Merchan pulled Blanche aside and told him Trump must stop cursing and shaking his head during Daniels' questioning.

The judge ruled that no photographers would be allowed in the courtroom today, so we won't be able to bring you any images until a court sketch is ready.

  18. Trump's lawyer having a difficult morningpublished at 14:59 British Summer Time 9 May

    Madeline Halpert
    Reporting from court

It’s been a difficult line of questioning for Donald Trump's lawyer, Susan Necheles.

First, she plays the wrong recording of a conversation between Stormy Daniels’ former lawyer Keith Davidson and Trump’s former lawyer, Michael Cohen.

When Necheles does play the right one, it doesn’t seem to confirm what she’s alleging - that Daniels told Davidson she was motivated by money, and had yelled at him that he needed to get her a deal before the 2016 election, otherwise they would lose all leverage.

Davidson seems to pose more of a hypothetical in the tape we just heard, and also appeared to reference Daniels' manager, Gina Rodriguez.

“I never yelled at Keith Davidson on the phone,” Daniels tells the court.

  19. Daniels pushes back against defence claimspublished at 14:57 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Trump's lawyer Susan Necheles is trying to make this cross-examination all about the money.

Over and over again she asks Daniels yes or no questions which attempt to support Necheles' argument that the adult-film star wanted money from Trump.

At one point, Necheles asks Daniels: "you either wanted money or you can hurt him politically".

Daniels continues to push back on this argument, saying that she wanted a non-disclosure agreement to protect her family, or to get her story out.

  20. Defence grills Daniels about motivation for moneypublished at 14:48 British Summer Time 9 May

    Kayla Epstein
    Reporting from court

Trump's lawyer, Susan Necheles, is picking up where we left off: the behind-the-scenes events that led to the $130,000 payment to Stormy Daniels.

Necheles is trying to argue that Daniels wanted to make money.

She asks if she wanted to take money from Trump or his lawyer at the time, Michael Cohen.

Daniels denies this, saying she was never asking for money from anyone in particular, she was asking for money to tell her story.

Daniels said she wanted to tell her story and get the truth out. She also wanted to be safe, she said, and eventually signed a non-disclosure agreement - an NDA.

But Necheles continues to press her about her motivations for eventually agreeing to the payout.
