Leicestershire's Clint McKay took four wickets but an unbeaten 10th-wicket Sussex stand of 75 left the hosts frustrated on day two.
Resuming on 322-7 Chris Jordan took three wickets, including Mark Cosgrove (128), to limit the home side to 340.
In reply Harry Finch (61) rallied but McKay's figures of 4-26 had Sussex toiling at 204-9 after tea.
But Vernon Philander (69*) and Danny Briggs (23*) ensured Sussex evaded the follow-on, closing just 64 runs behind.
The hosts frustratingly fell 10 runs short of a fourth batting point, while Australian McKay found himself on a hat-trick early in the Sussex innings.
Philander, playing his last game before teaming up with South Africa's squad for the Test series against England, took advantage of a tiring Leicestershire attack to claim his second half-century for Sussex before bad light ended play.
Sussex head coach Mark Davis told BBC Radio Sussex:
"At one stage it was a pretty precarious position to be in, but the boys have fought back really well and Vernon (Philander) batted outstandingly well. It was really good to see a bit of character shown.
"It was nice to knock them over quickly, and against the new ball on this pitch, everyone can see that it's pretty hard work. The odd ball is keeping low which is accentuated by the new ball.
"I see a very exciting game in prospect. Hopefully we can get a bit more wag from the tail to get us back in the game and then bowl well in the second innings and put them under a lot of pressure."
