In May, the Secretary of State for Communities said that the allotments could be built on as part of the Health Campus scheme which the council says will deliver more than 1,000 jobs and about 750 new homes. The authority says the allotments are needed to ensure the viability of the development.

Campaigners disagree and say the development can happen without the plots being destroyed. They went back to the High Court on 21 October to appeal the government's last decision.
