An attempt by Jaguar Land Rover to trademark the shape of the Defender has been rejected by the High Court.

The UK Intellectual Property Office refused the applications last year after an official decided that the shapes of the Defender 90 and 110 lacked "distinctiveness".

The High Court had been asked to rule on an appeal by JLR.

The firm stopped making the defender in 2016 and has since announced plans to make a replacement.

Harvey Eustace would like part of Olton Jubilee Park, in Solihull, to be turned into a place of remembrance with a cherry blossom tree, wildflowers and memorial stones.

The council has signalled it will donate the tree to the 10-year-old's scheme and his mother Steph Freeman told the Local Democracy Reporting Service it would be planted later this year.

She said she hoped the community would back a fundraising drive to raise the other £750 needed and her son was keen to see it created.

"Harvey is autistic … I think that’s why once he got it in his head he really wanted to run with it. I think it’s helped him through the isolation. It’s given him something to focus on.”

The bell was removed and placed on the nave but the repair firm, Taylor Bells, had to wait for the lockdown to end before collecting it.

Minister-in charge, the Reverend Pippa Thorneycroft, told the BBC at the weekend Taylor Bells was expecting to return the bell on Tuesday.
