Newcastle-under-Lyme Borough Council has written what's known as a "letter before action" to the operators of a landfill site after a number of complaints about the smell.
For months, hundreds of residents in Silverdale have complained about "the stink" from Walleys Quarry.
The local authority has now written to the site operators, Walleys Quarry Ltd, asking it to explain what measures it has been taking to improve the area.
The letter gives the company a chance to detail what it is doing, but is also a first step in the council taking the firm to court to issue an abatement notice.
That means it could legally stop it from doing anything which would cause the smell, or restrict it from operating.
