Ilkeston and Long Eaton town centres will have a by-law put in place giving police the power to stop people urinating and defecating in both towns.
The idea has been given the go ahead by Erewash Borough councillors, who hope that the new rule will come into force by the summer.
The council said police only have limited powers but the new by-law will make this type of behaviour a criminal offence.
Anyone caught not following the new rule will face a £500 fine.
The council has less than 28 days to publish the notice of the making of the by-law.

A World War One hero who was posthumously awarded the Victoria Cross has been recognised at Derby railway station with a plaque.
Jacob Rivers, from Chaddesden, worked for Midland Railway and was killed in the battle of Neuve-Chapelle in France in March 1915.
Mr Rivers was enlisted in 1899 and served with Royal Scots Fusiliers before working for the railway as a labourer.
At the outbreak of war he re-enlisted with the 1st Battalion Sherwood Foresters. He was awarded the VC for creeping "within yards of a very large number of enemy troops and 'hurled bombs on them'."
He repeated the action later that day only to be killed.
Andy Savage, executive director for the Railways Heritage Trust, said: "I think it's to the shame of the railway industry for Jake's name to not be there. He was not given the honors he deserved."
