  13. Lawyer hits out at plan to 'ban' homelessnesspublished at 11:00 British Summer Time 2 October 2018

    Nick Smith
    BBC News Online

A human rights lawyer has accused Nottingham City Council of attempting to ban homelessness.

Lara ten Caten, who works for charity Liberty, claims a new policy could see public space protection orders used to fine people for things like like obstructing doorways, or even giving food to people.

She said: "What Nottingham council is trying to do is to ban homelessness. They are trying to ban people from obstructing any building. Why are they trying to forbid people from giving things to people?

"They have very, very broad conditions. For example, they define giving free matter as any material, substance, object or thing.

"What this means, is you can’t give food to someone."

A spokesman for Nottingham City Council said: "It seems Liberty have leapt to the conclusion that we intend to use this PSPO like some other councils to target the homeless - we can assure them that's not the case."

They say it will be used instead to tackle businesses and charities distributing nuisance leaflets and flyers.

The council previously came under fire for anti-begging posters which "demonised" the homeless and were banned by the Advertising Standards Authority.

The leisure centre is now monitoring noise and recording levels within permitted decibels.

A spokesperson for the council said: "The council has noted the contents of the Ombudsman report, has accepted the findings and implemented the actions recommended by the Ombudsman."

The fine will be discussed at a full council meeting this evening.
