York's KitKats not unique enoughpublished at 13:50 British Summer Time 17 May 2017
The confectionery giant Nestle has lost its latest attempt to register the shape of its four-fingered KitKat as a trademark in the UK.
The chocolate bar is made at its York factory.
The Court of Appeal rejected its effort to overturn an earlier High Court ruling.
Nestle insists the shape of its four finger KitKat is iconic, but attempts to trademark the design have been fiercely resisted by its rival Cadbury for many years.
The UK high court said last year that the bar was not distinctive enough to merit protection.
A spokesperson for Nestle said they are "disappointed by the Court of Appeal judgment" and the firm is now "considering next steps."
