  18. Magistrate viewed 'irrelevant material' during hearingpublished at 16:30 British Summer Time 17 September 2018

A magistrate has been given formal advice by judicial heads after viewing "irrelevant material on a personal device" during a court hearing.

Phiroze Neemuchwala, who hears cases in south-east London, had been the subject of an investigation by the Judicial Conduct Investigations Office, which considers complaints about judges and magistrates.

Detail of the case emerged in a statement published on the office's website.

The statement said Mr Neemuchwala had been "subject to a conduct investigation after he viewed irrelevant material on a personal device during proceedings".

It added that although the outcome of the case he was hearing "was not affected", judicial heads issued Mr Neemuchwala with "formal advice" after concluding that his behaviour "amounted to misconduct".

The statement did not say what the "irrelevant material" was and did not give detail of the "personal device".

During the summer two other magistrates were investigated by the Judicial Conduct Investigations Office over their use of social media.

Roger Warrington was warned as a result of his "involvement in an inappropriate conversation", while Atul Gandecha was given "formal advice for misconduct" as a result of posting a caption "which could have created the impression that he did not take his role as a magistrate seriously".
