The viewing platform of a waterfall in Derby market place has been fenced off for safety reasons as people have been seen leaning over the edge.

There are steps leading up to the 11ft tall platform, from where the water used to fall before it was switched off on 31 March last year.

There have not been any recorded injuries, according to Derby City Council. However, the council said it was being pro-active to avoid any.

William Pye, who designed the feature, said fencing it off was "outrageous" and "pathetic".

He said: “Health and safety has a stranglehold, certainly on public art, which is trying to enhance the environment and it conspires to really spoil what people have done to try and make things more beautiful.”

However, Charlie Baldwin, who works nearby, said she has seen one person fall and many almost fall.

She added: “There was actually one where a guy was sat on the top, when the Manchester flowers and vases were there, and he fell into the flowers.”

Derby North MP Chris Williamson has suggested women-only train carriages could combat the rise in sexual offences on public transport.
