The case of Avni Metra, the double murderer who a judge today ordered should be sent back to his native Albania, will now be sent to the Home Secretary, Amber Rudd.

Metra came to the UK in the 1990s posing as a Kosovan asylum seeker. He was convicted of two counts of murder in Albania in his absence.

Mrs Rudd will make a formal decision on whether he should be extradited. In the meantime, Metra will remain in police custody, the Westminster Crown Court was told.

A double murderer who has lost his bid to avoid extradition back to his native Albania had claimed being sent back would contravene his right to a private and personal life.

Labourer Avni Metra had also told Westminister Magistrates' Court he had originally fled to Britain because his life was in danger after a friend was killed.

But today Judge Margot Coleman said: "You called absolutely no evidence to support your assertion that you would be denied the right to a fair trial.

"There are no grounds that have been heard before me to reach that conclusion.

"As far as your family are concerned, you were convicted of assaulting [your wife] and subjected to a restraining order."

Metra is also barred from seeing his children without permission, the court heard.

A judge who today ruled Avni Metra can be extradited back to his native home of Albania says his move to Hertfordshire was "based on a lie".

Speaking at Westminster Magistrates' Court, Judge Margot Coleman said: "It's right that you have lived here for some time and that you have a wife and children.

"When you entered this country you did not say you were Avni Metra from Albania. You gave a false name, saying you were seeking asylum from Kosovo.

"It was on that basis you were given leave to remain in this country and subsequently granted a British passport."

Metra, who was living in Borehamwood, Hertfordshire, was arrested by Scotland Yard detectives on June 8 as he drove through Watford, after a tip-off from the Daily Mail.

A father-of-four who is facing extradition to his native Albania has claimed he should be allowed to stay in the UK because of his family.

Avni Metra, from White House Avenue in Borehamwood, is wanted in his home country where he was convicted in his absence of two murders and possession of firearms dating back to the 1990s.

The 53-year-old fled to the UK claiming to be a Kosovan asylum seeker. Westminster Magistrates' Court will today decide if he should be extradited.

Hannah Hinton, representing the Albanian government, told an earlier hearing at the court that Metra had little contact with his children owing to a court order.

She said: "He may wish to have contact with them, but he is having no substantive contact with them here. He is not their carer, he is not an active parent to the four children."

Speaking through an interpreter at Westminster Magistrates' Court last week, Avni Metra told the court he fled Albania because "a police friend told me 'leave the country otherwise you are going to be killed - either it'll be by the government or someone else. There is no justice... only corruption".

The Hertfordshire resident's identity was revealed through a Daily Mail investigation. He claimed in court he changed his identity on arrival in the UK because an interpreter told him Abdul "sounded more Kosovan".

The father of four, from White House Avenue, Borehamwood, is fighting his extradition on human rights grounds, claiming his right to a family life in the UK. His legal team also told the court he would not be able to seek legal aid in Albania for his retrial.
