The judges at London's Criminal Appeal court also dismissed an appeal by Shazib Khan, 24, the uncle of Junead Khan, also of Marlow Avenue, Luton, against his sentence for a preparation for terrorism offence.

The pair had both planned, for almost an entire year over 2014 and 2015, to travel to Syria to live under the Islamic State regime.

The only reason they did not travel was because they had not saved up enough money or bought sufficient kit, Lord Thomas said.

Each received a seven-year term, with five years of extended licence, although Junead Khan's was to run concurrently to the sentence for the murder plot.

Dismissing Shazib Khan's application to appeal against that sentence, Lord Thomas said his complaints were unarguable.

  8. US air base attack plot: 'He did not carry his intention far'published at 10:31 Greenwich Mean Time 9 December 2016

After making the decision to overturn the life sentence of Junead Khan for plotting to kill US personnel outside a Lakenheath base, the judge, Lord chief justice Lord Thomas, said: "There is no doubt about the heinous nature of the crime which Junead Khan formed an intention to commit.

"But the point was fairly made on this appeal that, in terms of steps actually taken, he did not carry his intention far."

He added: "In the circumstances, neither the gravity of his conduct, very serious as it was, nor the level of danger which it indicated, required the court to impose a life sentence of imprisonment."

    Katy Lewis
    BBC Local Live

Councils in Beds, Herts and Bucks have made £22m from parking charges and fines in the last year.

In our area, Milton Keynes had the largest surplus of more than £10m - a rise of 80% - with Luton, Aylesbury, St Albans and Stevenage all making well over £1m each.

The authorities say they will be reinvesting their profits back into community transport schemes and RAC Foundation director Steve Gooding said that's what the law demands.

"The good news is that any profit generated by councils from on-street parking must, by law, be spent on transport-related activities and as every motorist knows there's no shortage of work that needs doing," he said.
