    Tory MSP Jamie Greene's amendments are on section 13 of the Bill which deal with empowering ministers to make keeping-pace regulations.

    His amendments seek to replace the world 'appropriate' with 'necessary'.

    The power to pass EU law into Scots law after exit day must only be done when it is necessary, the Tory MSP argues.

    Brexit Minister Mike Russell says there is a test of necessity in the Bill to ensure Scottish minsiters could only act where necessary.

    The Brexit minister says the Scottish government has made concessions in this area at Stage 2.

    He says Neil Findlay's amemdments, in the grounds for exercise of various regulation-making powers group, would make the Bill inoperable.

    However he back's Tory MSP Jamie Greene's amendments in the group.

    He says if MSPs back his amendment 23 and all of Jamie Greene's then the parliament will put logical limits on the ministerial powers in the Bill.

    Labour MSP Neil Findlay advocates the removal of the phrases 'necessary' and 'Scottish Minsters consider', which he argues will ensure the use of powers is more objective.

    He says his party accepts the need for ministers to be given additional powers but the amendments seek to "address a democratic imbalance".

    Labour will vote against amendment 23, he says, which seeks to replace the word 'necessary' with 'appropriate'.

    Scotland's Lord Advocate has defended the EU Continuity Bill brought forward by ministers as part of an ongoing row over post-Brexit powers.

    Presiding Officer Ken Macintosh has said the bill falls outwith the Scottish Parliament's remit.

    But top lawyer James Wolffe said the bill was "carefully framed" to be in line with UK and EU law.

    The government intends to press ahead with the legislation even without the backing of the presiding officer.

    MSPs will discuss proceeding with the UK Withdrawal from the European Union (Legal Continuity) (Scotland) Bill as an Emergency Bill on Thursday.

    This is an unprecedented move - a government bill has never before gone forward without the support of the presiding officer, and a bill has never received Royal Assent under these circumstances.

    Brexit Minister Mike Russell says the Tory amendment is unnecessary and is an "amendment telling us to behave ourselves".

    He urges MSPs to reject it, saying the Lord Advocate has explained why this Bill falls within the competence of the Scottish Parliament.

    Tory MSP Donald Cameron speaks to the only amendment in group 2 on 'legislative competence'.

    He warns that if this Bill passes, parliament will be rubber stamping legislation despite the presiding officer ruling it outwith its competence.

    Mr Cameron says his amendment seeks to "protect the government and save it from itself" by ensuring ministers cannot use powers to contradict the Scotland Act.

    "My amendment provides a legal lifeboat for the government and I urge ministers to swim for it."
