  17. Council considering challenge to 'unfair' tier allocationpublished at 13:16 Greenwich Mean Time 4 December 2020

    BBC Radio Leicester

Hinckley and Bosworth Borough Council is considering challenging the government over its tier three placing.

The area entered the highest tier, along with the rest of Leicestershire, when the national lockdown ended on Wednesday.

It means pubs and restaurants have to close except for takeaways and deliveries, and households cannot mix indoors or outdoors in private gardens.

The area had an infection rate of 94.6 per 100,000 people in the week up to 29 November, down from 214.8 the week before, according to latest figures.

The national average is 153.1, while Oadby and Wigston has the highest rate in the region at 287.6.

Councillor Michael Mullaney, from the authority, said: "We really believe it's completely unfair that for an area, which has such low levels, that we should be put into the most restrictive tier."

He said the government had been "very unfair" by grouping all of Leicestershire together and is working with other authorities to challenge the decision, which he says is damaging to local hospitality venues.

Elsewhere, Stratford-on-Avon District Council has submitted a legal challenge against its tier three allocation.

The authority said this week it had sent a judicial review pre-action letter to Health Secretary Matt Hancock.

The tier allocations are due to be reviewed every two weeks, with the first review expected on 16 December.
