A decision by North Yorkshire County Council to stop paying the care home fees of a woman in her 80s which left her owing £30,000 was wrong, according to the ombudsman., external
The authority originally agreed it was appropriate for the pensioner to stay in her care home and to pay the full costs of it.
It then carried out a review of her finances and stopped paying the costs, after deciding she'd deliberately reduced her savings, by giving money to family members.
An ombudsman investigation's concluded that because the woman had paid the full amount of her care for nine years, and that more than 70% of her money has been spent on care home fees, she hadn't deliberately given the money away to avoid the costs.
It's told the council to reassess the case and repay her any money she should have been entitled to.
Quote MessageJust because someone might be living in a care home, it doesn't mean they should not be able to continue to give gifts to friends and family.”
